Terms of Service

1. This agreement

These terms are a contract between you and [insert registered legal entity name and CIN before launch], which operates TimeIt at timeit.co.in. By creating an account or using the service, you accept them. If you do not accept them, do not use TimeIt.

Our Privacy Policy forms part of this agreement.

TimeIt is presently a preview build. Features are incomplete, data may be reset, and the service is provided for evaluation. Do not rely on it as your only record of anything that matters.

2. Who may use TimeIt

  • You must be at least 18 years old to hold an account. Accounts are for adults: parents, guardians, tutors and coaches.
  • A child never holds their own account. A child appears in TimeIt because a parent or guardian created their record, and reaches the app only through access that parent grants and can revoke at any time.
  • By adding a child, you confirm that you are that child’s parent or lawful guardian and that you are entitled to provide the information you enter and to consent to its processing.
  • By adding another adult — a second guardian, a tutor — you confirm you have their permission to enter their name and mobile number.
  • One person, one account. Do not share your number or your login codes with anyone.

3. What TimeIt is, and what it is not

TimeIt is a scheduling and record-keeping tool. It stores what you put into it and shows it back to the people you allow to see it. That is the whole of what we do.

Specifically, TimeIt does not:

  • Employ tutors. No tutor using TimeIt is our employee, agent or contractor. We do not pay them and we do not direct their work.
  • Vet, screen or background-check tutors. We do not verify qualifications, police records, references or identity, except where a listing explicitly says an identity document was checked, and even that is a check of a document and nothing more.
  • Endorse or recommend anyone. Appearance in the marketplace is paid advertising bought by the tutor. Ordering, badges and rankings are not our opinion of anyone’s competence or safety.
  • Supervise sessions. We are not present. Check-in records show that someone tapped a button on a phone; they are not proof that teaching occurred or that a child was safe.

The arrangement for tutoring, coaching or care is between the family and the tutor. You decide whom to engage, on what terms, and at what rate. Please do your own checks — meet the person, ask for references and identification, and use your judgement about leaving a child in anyone’s care.

4. Acceptable use

You agree not to:

  • Enter information about another person without their permission.
  • Use another person’s account, or try to reach data belonging to a family or tutor you are not part of.
  • Use location or check-in data to harass, stalk, intimidate or monitor anyone beyond what the feature is for.
  • Post anything unlawful, abusive, defamatory, obscene or discriminatory, including in messages to tutors or in marketplace listings.
  • Advertise falsely — misstate qualifications, experience, rates or availability in a listing.
  • Scrape, copy or resell data from TimeIt, or attempt to extract contact details in bulk.
  • Probe, disrupt or overload the service, or work around any technical limit or access control.
  • Use the service for anything other than the scheduling and record-keeping it exists for.

You are responsible for what you put into TimeIt. Keep your own copy of anything you cannot afford to lose — you can export at any time.

5. Payments and subscriptions

  • Prices are shown in Indian rupees and include applicable taxes unless stated otherwise.
  • Paid plans renew every month on the date you subscribed, and continue until you cancel. Marketplace listings for tutors work the same way and are billed only while the listing is live.
  • You can cancel at any time from your account settings. Cancellation stops the next renewal. Your plan keeps working until the end of the period you have already paid for.
  • Part-months are not refunded, except where Indian consumer law requires it or where we have clearly failed to provide the service.
  • Metered features — voice, WhatsApp and SMS beyond the included allowance — are billed at cost in arrears. The allowance and the rate are shown before you enable them.
  • Payments are handled by our payment processor. We never see or store your card number.
  • If a payment fails we will retry and tell you. Paid features may be suspended until it succeeds.
  • We may change prices with at least 30 days’ notice by SMS and in-app. The new price applies from your next renewal, and you can cancel before it takes effect.

Money you pay a tutor for teaching is between you and the tutor. Where TimeIt shows an invoice or passes a payment through, we are recording and routing your instruction; we are not a party to it, we do not guarantee it, and we do not arbitrate disputes about hours taught.

6. Your content, and ours

Everything you enter stays yours. You grant us only the permission we need to run the service — to store your data, show it to the people you have authorised, and back it up.

The TimeIt software, name, logo and design are ours. You may use the service; you may not copy, resell or reverse-engineer it.

7. Availability

We aim to keep TimeIt available but we do not promise it will be uninterrupted or error-free. We may take it down for maintenance, and we may change or withdraw features. During the preview period we may reset data with notice.

8. Limitation of liability

TimeIt is provided “as is”. To the fullest extent Indian law allows, we exclude all implied warranties, including fitness for a particular purpose.

We are not liable for:

  • the conduct, competence, honesty or safety of any tutor, coach, institution or other user;
  • anything that happens during a session, or any injury, loss or harm arising from an arrangement you made with a tutor;
  • a session missed, a clash not noticed, or a notification not delivered, including where a phone, network or SMS provider failed;
  • data you lost because you did not keep your own copy, or because your device or account was compromised;
  • indirect, incidental or consequential loss, or loss of profit.

Where we are liable, our total liability to you for all claims in any twelve-month period is limited to the amount you paid us for TimeIt in that period, or ₹1,000 if you paid us nothing.

Nothing here limits liability that cannot be limited by law — including for fraud, or for death or personal injury caused by our negligence.

9. Indemnity

If someone brings a claim against us because of what you put into TimeIt, because you broke these terms, or because of an arrangement you made with another user, you will cover our reasonable costs and losses from that claim.

10. Suspension and termination

  • You can leave at any time. Close your account from settings, or follow the data deletion route.
  • We may suspend or close an account that breaks these terms, that is being used to harm or endanger someone, that is fraudulent, or where we are required to by law. Where it is safe and lawful to do so we will tell you why and give you a chance to put it right.
  • Serious matters — risk to a child, fraud, abuse of another user — may be acted on immediately and without notice.
  • On closure your data is handled as described in the Privacy Policy. Financial records are kept for the retention period stated there.
  • Sections 6, 8, 9, 11 and this section survive termination.

11. Governing law and disputes

These terms are governed by the laws of India. Tell us about a problem first at support@timeit.co.in — most things are settled that way, and we will respond within 30 days.

If a dispute cannot be settled, it will be referred to arbitration by a single arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue is [insert city — typically the registered office], India, and the language is English. Subject to that, the courts at [insert city] have exclusive jurisdiction.

Nothing here stops you from taking a complaint to a consumer forum under the Consumer Protection Act, 2019, or from approaching the Data Protection Board of India about a privacy matter.

[An arbitration clause against consumers is not always enforceable in India. Have counsel confirm this clause, and the grievance officer details required under the IT Rules, before launch.]

12. Changes to these terms

We may update these terms. The date at the top always shows the current version. For material changes — anything affecting your rights, your money or your liability — we will give you at least 30 days’ notice in the app and by SMS before they take effect. If you keep using TimeIt after that, the new terms apply. If you do not accept them, close your account before the date they take effect.

13. General

  • If any part of these terms is held unenforceable, the rest continues to apply.
  • Not enforcing something once does not mean we give up the right to enforce it later.
  • You may not transfer your account to someone else. We may transfer this agreement if the business is sold, on the same terms.
  • These terms and the Privacy Policy are the whole agreement between us.
